Optimal Bet API Terms of Use

Welcome to the Optimal Bet API ("Service"). These Terms of Use ("Terms") govern your access to and use of the API provided by Hergott Technologies, Inc. ("Optimal Bet," "we," "us," or "our") at https://api.optimal-bet.com. By using the Optimal Bet API, you agree to these Terms. We encourage you to read them carefully—our goal is to provide a reliable service and a fair agreement for both sides.

1. Eligibility

You must be of legal betting age in your jurisdiction to use the Service. If your jurisdiction does not specify a legal age, you must be at least 18 years old.

We’re excited for you to build on the Optimal Bet API. To keep the ecosystem secure and fair for everyone, here are a few things you agree not to do:

• Use the Service to create or offer a competing product or service that provides direct access to or resales of Optimal Bet API data
• Use the API in violation of any applicable law or regulation, including the facilitation of illegal betting or gambling activity
• Access the API in any way that harms, disables, or disrupts our infrastructure or systems
• Scrape, reverse engineer, decompile, or attempt to gain unauthorized access to the Service or any data therein
• Circumvent or attempt to circumvent rate limits or usage restrictions imposed by the Service

4. Intellectual Property

All rights, title, and interest in and to the Service, including data, software, and branding, remain with Optimal Bet. You may not use the Optimal Bet name, logo, or branding in any way that implies partnership, endorsement, or official status without our prior written consent.

5. Fees and Payment

Certain features of the API may require payment. All fees are non-refundable unless stated otherwise. We reserve the right to change pricing at any time. Failure to pay applicable fees may result in suspension or termination of your access.

6. Data Availability and Accuracy

We do not guarantee the completeness or accuracy of the data at all times, and availability may be affected by technical issues or changes in access.

7. Uptime and Service Level Disclaimer

We strive for high uptime and reliable performance, but we can't guarantee uninterrupted access. Planned maintenance or unexpected outages may occur. We may also add, modify, or remove features of the API at any time without liability or notice.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, your license to use the API and all associated data ceases immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. OPTIMAL BET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTIMAL BET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Optimal Bet and its affiliates, officers, agents, and employees from any claims, damages, liabilities, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Changes to the Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles.

14. Survival

Sections related to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification shall survive termination of your use of the Service.
